Welcome to Canaria Club, a platform designed to connect visitors to Tenerife with live music events, entertainment options, and special offers from local businesses. These Terms and Conditions govern your use of the Canaria Club platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Platform.

Canaria Club provides an information service connecting holidaymakers with entertainers, venues, excursion companies, and restaurants in Tenerife and, in the future, other Canary Islands. Our platform facilitates discovery and connection but does not directly provide entertainment services, operate venues, or run excursions.

In these Terms and Conditions, the following terms have these meanings:

  • "Canaria Club", "we", "us", or "our" refers to Canaria Club, the operator of this Platform.
  • "Platform" refers to our website, mobile application, and related services.
  • "User", "you", or "your" refers to any person accessing or using our Platform.
  • "Artist" refers to performers, musicians, entertainers, or other individuals who create an account to list their performances on our Platform.
  • "Venue" refers to establishments where performances take place, including but not limited to bars, restaurants, hotels, and entertainment centers.
  • "Venue Owner" refers to individuals who have claimed and manage the profile of a Venue on our Platform.
  • "Booking" refers to a scheduled performance by an Artist at a Venue.
  • "Subscriber" refers to Users who have paid for premium access to our Platform.

3.1. Account Types

Our Platform offers different types of accounts: general User accounts, Artist accounts, and Venue Owner accounts. Each account type has specific features and responsibilities.

3.2. Registration Requirements

To create an account, you must:

  • Be at least 18 years of age
  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account

3.3. Artist Accounts

If you register as an Artist, you represent that you have the authority to list your performances and that all information provided about your services is accurate and up-to-date.

3.4. Venue Claiming

Venue Owners may claim their Venue profile through our verification process. Once a Venue is claimed, the Venue Owner can manage bookings, add or remove information, and respond to Users.

3.5. Account Restrictions

You may not:

  • Create multiple accounts for improper purposes
  • Impersonate any person or entity
  • Use the account of another without permission
  • Provide false or misleading information

4.1. Subscription Options

We offer subscription plans that provide enhanced features, including notifications about favorited Artists, access to special offers from excursion companies and restaurants, and other premium content.

4.2. Payment Terms

All payments are processed securely through our payment providers. By subscribing, you agree to pay the fees indicated for your selected subscription plan. All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.

4.3. Subscription Renewals

Subscriptions automatically renew until canceled. You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing period.

4.4. Changes to Subscription Plans

We reserve the right to modify subscription plans and pricing at any time. Any changes will be communicated to you before they take effect, and will apply to the next billing cycle unless otherwise indicated.

4.5. Free Services

Some Platform features are available without a subscription. We reserve the right to modify, limit, or eliminate free services at any time.

5.1. User-Generated Content

You retain ownership of any content you submit to our Platform, including photos, reviews, comments, and other materials ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing our services.

5.2. Content Restrictions

You may not post, upload, or share content that:

  • Is false, misleading, deceptive, or inaccurate
  • Infringes on any third party's intellectual property or other rights
  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer system
  • Advertises or solicits business not related to the Platform's purpose

5.3. Monitoring and Removal

We do not actively monitor User Content but reserve the right to review and remove any content that violates these Terms or that we deem, in our sole discretion, to be inappropriate, offensive, or illegal.

6.1. Artist Responsibilities

Artists are solely responsible for:

  • Maintaining accurate and up-to-date information about their services
  • Creating and managing their bookings accurately
  • Promptly updating or canceling bookings when necessary
  • Ensuring they have all required licenses, permits, and insurance to perform
  • Fulfilling all commitments made to Venues and attendees

6.2. Venue Owner Responsibilities

Venue Owners are solely responsible for:

  • Verifying the accuracy of Bookings at their Venue
  • Managing and updating Bookings at their Venue
  • Notifying Artists and the Platform of any changes or cancellations
  • Ensuring their Venue complies with all applicable laws and regulations

6.3. Booking Accuracy

While we strive to provide accurate information, Canaria Club does not guarantee the accuracy of Bookings displayed on the Platform. Artists and Venue Owners control the creation and management of Bookings, and changes or cancellations may occur without advance notice to the Platform or its Users.

6.4. Disputes Between Artists and Venues

Any disputes between Artists and Venues regarding bookings, payments, performances, or other matters must be resolved directly between the involved parties. Canaria Club is not responsible for mediating or resolving such disputes.

7.1. Information Accuracy

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not review all content provided by Artists and Venues for accuracy. We cannot guarantee that any Artist will perform as scheduled or that Venues will operate as described.

7.2. No Responsibility for Performances

CANARIA CLUB TAKES NO RESPONSIBILITY IF USERS ATTEND A VENUE AND THE ARTIST IS NOT PERFORMING.Artists and Venue Owners control their bookings and cancellations. While we encourage Artists and Venues to keep information current, we cannot guarantee the accuracy of any booking information.

7.3. Not a Booking Service

Canaria Club is an information platform that facilitates discovery of entertainment options. We are not a booking service, ticket seller, or event organizer. We do not guarantee entry to any venue or event.

7.4. No Endorsement

Listing an Artist, Venue, excursion, or restaurant on our Platform does not constitute an endorsement of their services. Users should exercise their own judgment when deciding which services to use.

7.5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CANARIA CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.This includes, but is not limited to, damages arising from:

  • Your use of or inability to use our Platform
  • Canceled or changed performances
  • Any conduct or content of any Artist, Venue, or other third party
  • Unauthorized access, use, or alteration of your content or transmissions

7.6. Excursions and Restaurant Offers

Canaria Club is not responsible for the quality, safety, or outcome of any excursion or restaurant experience. All offers are provided directly by the businesses, and any issues should be addressed with them directly.

Our Privacy Policy, available at [Privacy Policy URL], describes how we collect, use, and share your personal information. By using our Platform, you consent to our collection and use of data as described in the Privacy Policy.

8.1. Push Notifications

Subscribers may receive push notifications about favorited Artists and other updates. You can manage notification preferences in your account settings. By enabling notifications, you consent to receive them according to your preferences.

8.2. Location Data

Some features of our Platform may use location data. You can control this in your device settings. By enabling location services for our Platform, you consent to our collection and use of location data as described in our Privacy Policy.

We may modify these Terms at any time by posting the revised Terms on our Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

For material changes, we will make reasonable efforts to notify you, such as through a notification on the Platform or via the email associated with your account. It is your responsibility to review these Terms periodically.

We reserve the right to suspend or terminate your access to our Platform at any time, without notice, for any reason, including if we believe you have violated these Terms.

You may terminate your account at any time by following the instructions in your account settings. Termination of your account does not relieve you of any obligations incurred prior to termination.

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Tenerife, Spain.

Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at hola@canariaclub.com. If we cannot resolve the dispute within 30 days, either party may initiate formal proceedings.
